ART PROGRESS
☘ You, the commissioner, agree to my TOS once contacted and paid for work to be completed by the artist (Gothic Siamese).☘ When purchasing artwork from me you are agreeing that you are 18 years or older.☘ I have right to decline anything that I may feel uncomfortable drawing or handling! Please respect that.☘ Art is normally done in queue listing and I sometimes work in bulk when it comes to certain types of commissions (i.e. stickers & YCHs). I may jump around to sort out and knock out simpler commissions, but I always aim to get everything done in a timely manner.☘ If you have a specific date that you'd like art done, it needs to be stated prior to purchase and not afterwards. If I cannot meet your demands for a certain due date, it will be declined. If I can make room for your commission for a short deadline, I will require a rush fee (listed in time section).☘ I will need to receive FULL payment before projects will be worked on. For larger projects of $200 and up: work does not start until at least 50% has been paid for the project and only sketching phase will be done until full payment is made.☘ Everything commission wise (prelims, files sent, etc) will be handled in email. I do not handle commissions over Telegram or Discord at this time to avoid any confusion and lost information. In the chances of a website going out on short notice, there will always be the email option available ( gothicsiameseart @ gmail.com ).☘ Artist is not obligated to keep commission files after commission is completed and sent to its owner. Artist is not responsible to: replace files, refund buyer, or re-draw the art. (I try to keep files just in case, but I cannot guarantee they'll be around forever unfortunately due to disk space!)
PAYMENT
☘ I will send you an invoice for the amount or send you to a Wufoo form for payment. If you need to use a specific type of payment method, please feel free to contact me. I will not be able to accept all types, but I may have some options.☘ I will hold your slot for a total of 48 hours. If payment has not been made within that time, you will forfeit your commission slot and it will go to the next customer. This can be discussed if you need to wait till your payday, but needs to be mentioned beforehand or you will fall into this rule! If you need to have a certain day to pay, you will have 48 hours after that date chosen.☘ I understand that some commissions may seem expensive or out of your price range, I am willing to accept payment plans to make commissioning me easier for you. Payment plans must be discussed if requested PRIOR to acceptance of commission.
TIME
☘ Depending on the commission you purchased and placement on my work queue, commissions can take from a couple days to a few weeks. I do try to work as fast as I can without sacrificing art quality. Larger projects MAY take longer depending on the size of said project.☘ If something comes up to where it may take longer, you will be notified in notes or email of the situation. Journals, tweets and other posts will be made to notify everyone. I do my best to make sure everyone is on the same page!☘ Collaborations (collabs) may take longer than the times listed here, as I am only doing partial of the work involved.☘ I have a work schedule for Monday-Friday. I do not work on weekends or any holidays.☘ Rush fees will be added to the cost of the commission if required by a short deadline. However I may pass up on any deadlines I am not comfortable doing. There will be a 50% to final cost of commission for rush fees.
CHARACTER INFORMATION
☘ Supply as much information as you can of your character, references (either a reference sheet and/or other pictures done of your character this also includes SL reference sheets), what you'd like in the picture and anything else that may help me get what you're looking for.☘ I can work from descriptions but they MUST be full detail to get exactly what you want. No vague descriptions please. This may result in an extra fee, depending on if it is all text with no reference sheet of the character in question.☘ Complex Characters Warning: Characters with a lot of distinctive markings, very complex coloration, or things of this nature may raise the price, due to the extra work involved.☘ Please be sure to have all permissions before using someone's character that is not your own. Artist is not responsible for any characters used without permission, however artist will gladly take down the artwork and request removal if posted elsewhere if the original owner has issues with the artwork in question. No refunds will be given, however the image may be re-altered for a fee.☘ Artist is not responsible or obligated to refund or offer a rework for partner pieces that have had a falling out or break up with friends/lovers/significant others/etc. An edit can be made for an extra fee if requested.
PRELIMS
☘ Sketches, sketch related, icons and any "small and quick" commissions will not have any prelims or 'approval' emails sent. Please be specific on what you'd like for these in your descriptions, or state you wish for artistic freedom.☘ Prelims can be supplied for pictures that require it if requested by the commissioner (I.E comic projects, large projects & character sheets). This is for all art done by the artist, this does not include YCH and/or 'collabs' with other artists unless stated in the collab/ych information. If there is any prelim/approval needed, please state everything that requires to be tweaked. There is an allowance of two (2) prelims for changes before a charge may be required of $5 each prelim.☘ I am rather confident with my work and will work start to finish and give finished results on all picture commissions if not asked for prelims. If I have any questions I will notify you.☘ If there is a mistake made on my end that was specifically described in the commission that I have overlooked, I will make needed tweaks to accommodate the mix-up. This includes: markings, character placement, changing of species, etc. If the information was NOT included and was on the commissioner's end, I am not responsible. I am willing to make changes for an additional fee if it is on the customer's end.
REFUNDS
☘ Full refunds will ONLY be issued if I have not yet started on your piece or I have decided not to proceed with the work due to real life (RL) reasons.☘ If you decide you do not wish to keep going, quit or decide to find someone else to do your concept and artwork has been started, near completion or completed, you will receive a full refund. Your art that was in progress may or may not be repurposed as a YCH for sale as I am the copyright holder of the images created.☘ Please understand that I will not refund anyone that has received work from me, if you are truly unsatisfied I will discuss it with you in email. I as an artist am not obligated to refund a commissioner for the following reasons: wrongful purchase, impulse purchasing, disappointed in art, bored of art, impatient of production, not what buyer expected, buyers remorse, etc. If the work is done, I will not refund.☘ You are required to pay for your commission yourself with your own means and are completely liable to pay for the commission regardless of the situation afterwards. In the case someone else is paying for you, you are liable to pay in the case of a charge-back or similar type situation.☘ Artist's family & friends are not obligated to refund commissioner in cases that the artist becomes extremely ill or deceased. Funds that were earned while artist was healthy/alive will be used as donations towards family expenses. Commissioner is aware of this when purchasing from artist.
ART TRADES & FREE ART
☘ When art trades are accepted, I am looking for artists that have a similar quality in artwork that I have. It doesn't need to be similar in style, only quality. Please do not feel offended if I feel your artwork is not up to the same quality as mine. This is me doing work for you and you doing work for me for an equal value.☘ Trades are placed on my work list and will be worked on between commission slots. They are treated as if you commissioned me with money.☘ Trades will be finished and posted once they are done in a smaller sized/watermarked version after I have seen proof of concept of the other half of the trade. Full sized & non-watermarked version will be sent via email once both sides of the trade is completed in full.☘ While there may be a chance of "free art" either it be from a contest, giveaway, etc. Please understand that paying customers DO come first. This is just to let people know that free art does not get priority over paying customers.
COPYRIGHT AND PERMISSIONS
☘ I retain the copyright to the image(s). This means that I, and only I, can make reproductions, use as an advertisement, sell prints, or make revisions and edits. An individual can buy the copyright for an additional price if they commissioned the piece(s).☘ The commissioner is permitted to post the completed work to their personal galleries (or Twitter, Facebook, etc) as long as the work is credited back to myself as the artist.☘ If you, the commissioner, would like your commission to be kept "private", please state so ahead of time in your request. There WILL be an extra charge for these sorts of requests (a fee of $20 and up). The reason for this is because it takes away advertisement and business from myself. Private commissions will never be shown or printed. If it is meant for a special surprise to someone (anniversary, birthday, etc), I can keep it private and post a few days later with no issues.☘ If you, the commissioner, would like to be listed as "anonymous" instead of your username, please let me know in your commission request so I can do this properly! Otherwise a link to your account will be done as a credit to you.☘ The commissioner retains rights to the characters depicted in the image. This means that while I am able to reproduce or alter the specific work, I am not allowed to use the characters in any future work without the commissioner's permission.☘ The commissioner is also allowed to make icons, wallpapers, etc of the art they have purchased for their self. They are also allowed to make a print for PERSONAL USE to put in a frame, on their wall, etc.☘ The commissioner in no way may make profit off their commission. You may pay a printing company (ex. Staples) to make a professional print for you for personal use or pay the artist to make a print for you. If you wish to use your commission for free stickers, business cards, etc, you will need to contact the artist about credits. If you wish to make profit off your commission you MUST contact the artist for copyright purchase(s).☘ Any sketches that were rejected from any commissioner may be recycled for later use. It is not the commissioner's to keep unless stated otherwise or if purchased.
